The responsible party for personal information processed through this website is:

Trading name: Lumizique
Website: https://lumizique.co.za
Email: info@lumizique.co.za

  1. PERSONAL INFORMATION WE COLLECT

Depending on how you interact with Lumizique, we may collect:

  • your name and surname;

Online payments are processed through Yoco or another payment provider identified at checkout. Lumizique does not ordinarily receive or store your complete bank-card details.

Please do not submit medical information or other sensitive personal information through product reviews, order notes or general contact forms unless Lumizique has specifically requested it for a lawful and necessary purpose.

  1. HOW INFORMATION IS COLLECTED

  1. WHY WE PROCESS PERSONAL INFORMATION

We may process personal information to:

  • create and maintain customer accounts;
  • accept, confirm and fulfil orders;
  • process or verify payments;
  • arrange delivery or local pickup;
  • provide order, dispatch and collection notifications;
  • respond to enquiries, complaints and return requests;

  • send marketing where you have consented or another lawful basis exists;
  • protect Lumizique’s legal rights; and
  • meet accounting, tax, consumer-protection, regulatory and other legal obligations.
  1. LAWFUL PROCESSING

Lumizique will process personal information only where it is lawful and reasonably necessary, including where:

  • the information is needed to complete or administer an order;
  • processing is required by law;
  • processing protects a legitimate interest of Lumizique, the customer or another person;
  • you have consented to the processing; or
  • another lawful justification under POPIA applies.

You may withdraw consent where processing is based on consent. Withdrawal does not make earlier lawful processing invalid and may not prevent processing required to fulfil an existing order or legal obligation.

  1. PAYMENT PROCESSING

Payments are processed by Yoco or another payment service displayed at checkout.

Payment providers process information according to their own privacy and security practices. Customers should review the applicable provider’s privacy information.

Lumizique may receive information such as the transaction reference, payment amount, payment status and limited payment-method details required to administer the order.

  • a purchaser or successor if the business is lawfully sold or reorganised.

These providers may process information only for the relevant service or another lawful purpose.

Lumizique does not sell customers’ personal information.

  1. DELIVERY INFORMATION

Where delivery is selected, we may provide the courier with the recipient’s name, delivery address, telephone number, email address, order reference and other information reasonably required to complete or communicate about the delivery.

  1. COOKIES

The website may use essential cookies for:

  • shopping-cart operation;
  • checkout and payment sessions;
  • account login;
  • security and fraud prevention;
  • remembering customer preferences; and
  • basic website performance.

Optional analytics or marketing cookies should be used only with the appropriate notice or consent where required.

Blocking essential cookies may prevent the cart, login or checkout from working correctly.

  1. DIRECT MARKETING

Lumizique may send marketing communications only where permitted by law.

You may opt out using the unsubscribe link in a marketing email or by contacting info@lumizique.co.za.

Opting out of marketing does not stop essential messages concerning an order, payment, delivery, collection, security issue or legal notice.

  1. RETENTION OF INFORMATION

Personal information will be retained only for as long as reasonably necessary to:

  • fulfil the purpose for which it was collected;
  • administer customer accounts and orders;
  • resolve disputes and complaints;
  • prevent fraud;
  • comply with accounting, tax and legal recordkeeping requirements; and
  • establish, exercise or defend legal claims.

When information is no longer required, it will be securely deleted, destroyed or de-identified where reasonably possible.

  1. INFORMATION SECURITY

Lumizique uses reasonable technical and organisational safeguards to protect personal information against loss, unauthorised access, alteration, disclosure or destruction.

No internet-based system can be guaranteed to be completely secure. Customers are responsible for keeping their account passwords confidential and must notify Lumizique if unauthorised account activity is suspected.

If a security compromise involving personal information occurs, Lumizique will take reasonable containment and corrective steps and will provide notifications required by POPIA.

  1. CROSS-BORDER PROCESSING

Some hosting, ecommerce, payment, email or technical service providers may process information outside South Africa.

Where cross-border processing occurs, Lumizique will take reasonable steps to ensure that the transfer is permitted under POPIA and that appropriate protections apply.

A person younger than 18 should use the website or place an order only with the knowledge and permission of a parent or legal guardian.

Lumizique will not knowingly process children’s personal information in a manner requiring prior authorisation without obtaining the necessary consent or authorisation.

  1. YOUR RIGHTS

Subject to POPIA and other applicable law, you may request that Lumizique:

  • confirm whether it holds your personal information;
  • provide access to your personal information;
  • correct inaccurate or incomplete information;
  • delete or destroy information that may lawfully be deleted;
  • restrict or stop unlawful processing;
  • record an objection to particular processing; or
  • stop sending direct marketing.

Lumizique may require reasonable proof of identity before processing a privacy request.

Certain information cannot be deleted immediately where retention is required by law, needed to complete an order or necessary for legal claims.
